League of Women Voters to Hold Land Use Public Forum Nov 11

Walton will present the League of Women Voters’ November Land Use Forum, scheduled for 1 p.m. November 11, at the Bob McCurry Conference Room, Medical Arts Building Entrance, at the Beebe Medical Campus on Route 24, Rehoboth Beach. The topic is Property Rights and “Takings.” “This is one of the hottest topics affecting land use decisions here in Sussex, “ said LWV President Esther Shelton. “We are very fortunate to have one of the state’s leading experts on this topic as our speaker on this topic. Max Walton specializes in advising state and local government agencies on the legal basis for respecting property rights in any property or regulatory actions or ‘takings’ that affect property rights. And he’s reputed to be a great speaker. This promises to be a fascinating and informative session,” Shelton added.

Walton is a litigation partner in the Connolly Bove Lodge & Hutz LLP Business Law Group based in Wilmington. He is a frequent lecturer for the University of Delaware’s Institute for Public Administration, and gives seminars on various topics including land use law, constitutional law, agency procedure, and takings. He is also the editor of and frequent contributor to the Delaware Government Legal Quarterly.

Walton has significant lead counsel experience in matters involving commercial, constitutional, land use, construction, and related matters in Delaware State courts. He acts as outside counsel for numerous State, County, and municipal governments and agencies.
In conjunction with other Connolly Bove attorneys, Max recently successfully defended the State of Delaware in an original jurisdiction action before the

United States Supreme Court concerning Delaware’s rights to exercise its police power over subaqueous lands in the Delaware River. State of New Jersey v. State of Delaware, — U.S. –, 128 S.Ct. 1410 (2008).
